Doctor Negligence for Failing to Provide Oxygen Post-Surgery
Our Case *
This is a medical malpractice case involving Edith
Madison, who at age 64 was an active person. On January
20, 1991, while hanging curtains for her daughter,
she fell and sustained a fracture of her left hip
and distal left wrist. She was admitted to the Hospital
by ambulance to the service of Dr. Bruce Martin, an
orthopaedist. On January 21, 1992, Dr. Martin performed
a hip arthroplasty and a closed reduction of the left
wrist. The procedure lasted approximately 2.5 hours.
Mrs. Madison was taken to recovery, not receiving any supplemental oxygenation
until she was reattached to the ventilator.
Mrs. Madison failed to awake post-operatively and thereby suffered a coma. She
remained in a coma for approximately 2 and 1/2 weeks, but eventually woke up.
Mrs. Madison awoke despite notes from treating doctors to "consider the possibility
of terminating life support."
When she awoke, she had significant neurological problems including memory, loss,
the inability to talk, the inability to walk and the inability to comprehend
simple statements and tasks, etc. Mrs. Madison was then sent to Hospital Rehabilitation
for approximately two and one-half (2 1/2) months.
The Verdict
