Nursing Home Negligence
Our Case
Harold Johnson, decedent was a resident of defendant
Nursing Home for approximately 14 years. He had significant
health history including, arteriosclerosis, schizophrenia,
cognitive disorders with dementia, and seizures.
He was admitted to the Hospital in May 2000 for a right Pneumothorax and returned
to the Nursing Home after chest tube re-inflation. Mr. Johnson's family observed
the suffering of Harold over the following months, expressed by moaning, teeth
chattering, significant weight loss, not eating, not drinking and severe dehydration.
This problem was an ongoing problem for many months and in October 2000, defendant
doctor Samson suggested a feeding tube. On October 5, 2000 due to progressive
dehydration Mr. Johnson was transferred to the Hospital.
Upon physical exam, Mr. Johnson was found to have a pulsatile abdominal mass
of approximately 6 to 11 cm. A CT Scan of the abdomen revealed ruptured aneurysm
leakage into the left retro peritoneum. Because of Mr. Johnson's debilitated
condition, his family was advised of the high risk surgery would pose. The surgery
to repair his aorta was successful, but post operatively Mr. Johnson remained
hypotensive and subsequently died.
Why were defendants negligent?
The inadequate management of Mr. Johnson by Dr. Samson and staff at the Nursing
Home caused Mr. Johnson to suffer a premature and avoidable death.
